1. About Us
These Terms of Service ("Terms") govern the use of the Bugzy AI platform ("Platform") and services ("Service") provided by:

These Terms are available at https://bugzy.ai/terms and apply together with our Privacy Policy, Cookie Policy, and Data Processing Agreement (which constitutes an appendix to these Terms).
2. Definitions
In these Terms, unless the context clearly indicates otherwise, the following terms have the meanings set out below:
- "Service" means the Bugzy AI autonomous QA agent platform, including all features, functionalities, integrations, and related services provided by Cloud Automation Solutions EOOD through the Platform.
- "Platform" means the web application accessible at https://bugzy.ai and any associated tools, APIs, and interfaces through which the Service is delivered.
- "Customer" means the legal entity (company, organization, or other business entity) that registers for and uses the Service. For the avoidance of doubt, the Service is intended solely for business use and is not available to consumers or natural persons acting outside their trade, business, craft, or profession.
- "User" means any individual authorized by the Customer to access and use the Service on the Customer's behalf, including the Customer's employees, contractors, and consultants.
- "Visitor" means any individual who accesses the Platform without registering an account.
- "Account" means the registered account created by the Customer to access and use the Service.
- "Subscription" means the paid plan selected by the Customer that determines the scope, features, and usage limits of the Service.
- "Your Content" means any data, content, documentation, code, materials, or information that the Customer or its Users submit to, upload to, or make accessible through the Service, including content from integrated third-party systems.
- "Feedback" means any feedback, comments, suggestions, ideas, or recommendations provided by the Customer or its Users regarding the Service.
- "Confidential Information" means any non-public information disclosed by either party to the other, whether in writing, orally, or by other means, that is designated as confidential or that a reasonable person would understand to be confidential given the nature of the information and circumstances of disclosure.
- "Third-Party Services" means external software, platforms, and services (such as GitHub, Slack, Jira, and others) that may be integrated with the Service.
- "AI-Generated Content" means test plans, test cases, bug reports, analysis, and other outputs generated by the Service using artificial intelligence models.
- "DPA" means the Data Processing Agreement, available at https://bugzy.ai/legal/dpa, which forms an appendix to these Terms.
3. Agreement to Terms and Scope
3.1 Acceptance
By accessing the Platform, registering an Account, or using the Service, the Customer agrees to be bound by these Terms and all documents referenced herein, including the Privacy Policy, Cookie Policy, and DPA. If the Customer does not agree to these Terms, the Customer may not access or use the Service.
By registering an Account, the person creating the Account represents and warrants that they have the authority to bind the Customer to these Terms.
3.2 B2B Service Only
The Service is intended exclusively for business and professional use. The Service may only be used by legal entities and is not offered to consumers or natural persons acting outside their trade, business, craft, or profession. By using the Service, the Customer confirms that it is a legal entity acting in its professional capacity.
3.3 Applicability
These Terms apply to all Customers, Users, and Visitors who access or use the Platform and the Service.
4. Description of Service
4.1 Service Overview
Bugzy AI is an autonomous QA agent platform that provides AI-powered automated testing, quality assurance, and bug detection services for software projects. The Service uses artificial intelligence (including large language models provided by third-party AI providers) to:
- Generate and execute automated test cases
- Identify bugs and quality issues in the Customer's applications
- Integrate with the Customer's development workflow through Third-Party Services
- Provide AI-Generated Content including test plans, bug reports, and quality insights
4.2 AI-Generated Content Disclosure
In accordance with Article 50 of the EU AI Act, the Customer acknowledges that:
- The Service generates synthetic content (test plans, test cases, bug reports, and analysis) using artificial intelligence systems.
- All AI-Generated Content is clearly identified as AI-generated within the Platform.
- AI-Generated Content may contain errors, inaccuracies, or omissions. The Service does not guarantee the accuracy, completeness, or reliability of AI-Generated Content.
- The Customer is solely responsible for reviewing all AI-Generated Content before relying on it or deploying it in a production environment. AI-Generated Content does not constitute final decisions and must be reviewed by a qualified human (developer, QA engineer, or equivalent) before acting upon it.
4.3 Downstream AI Provider
The Service uses third-party AI models (specifically Anthropic's Claude API) for test generation and analysis. Cloud Automation Solutions EOOD acts as a downstream provider under the EU AI Act. The Customer's data is processed according to the Customer's instructions and is not used for training third-party AI models, in accordance with the applicable commercial terms of the AI provider.
4.4 AI Literacy
In accordance with the EU AI Act, the Customer agrees that its personnel who use the Service are adequately informed about and familiar with the capabilities, limitations, and proper use of the AI-powered features of the Service.
4.5 Prohibited AI Use
The Customer shall not use the Service for purposes other than software quality assurance and testing. In particular, the Customer shall not use the Service for: employee performance evaluation, HR decision-making, biometric identification, law enforcement, or any purpose that falls within the high-risk AI system categories under Annex III of the EU AI Act. Use of the Service for such purposes would change the risk classification of the product and the Customer bears sole responsibility for any regulatory consequences arising from such misuse.
5. User Accounts
5.1 Account Creation
To use the Service, the Customer must create an Account by providing accurate, complete, and current information, including:
- A valid business email address
- The Customer's company name and relevant business identification data
- The name and contact details of the Customer's authorized representative
Upon registration, the Customer will receive a verification email. The Account will only be activated after successful email verification. The Customer must ensure that all information provided during registration is truthful and up-to-date.
5.2 Consequences of Inaccurate Information
Providing false, incomplete, or misleading information during registration or at any time thereafter constitutes a breach of these Terms. Cloud Automation Solutions EOOD reserves the right to refuse registration, suspend, or terminate the Account if the information provided is found to be inaccurate.
5.3 Account Security
The Customer is responsible for safeguarding all credentials used to access the Service and for all activities and actions under its Account. The Customer must:
- Keep all login credentials confidential and not share them with unauthorized persons
- Ensure that each User has individual login credentials
- Notify us immediately at support@bugzy.ai in the event of any unauthorized access to or use of the Account
- Ensure that Users log out at the end of each session when using shared devices
Cloud Automation Solutions EOOD shall not be liable for any loss or damage arising from the Customer's failure to comply with these security obligations.
5.4 Account Eligibility
The person creating the Account must be at least 18 years old, have the legal capacity to enter into contracts, and be duly authorized to act on behalf of the Customer.
5.5 Account Use by Third Parties
The Customer shall not allow any person other than authorized Users to access or use the Service through its Account. The Customer is responsible for ensuring that any User who is no longer authorized (e.g., former employees) has their access promptly revoked. The Customer bears full responsibility for all activities conducted through its Account, including actions by third parties resulting from the Customer's failure to maintain Account security.
6. Acceptable Use
6.1 Permitted Use
The Customer may use the Service only for lawful business purposes and in accordance with these Terms. The Customer agrees to use the Service in a professional and ethical manner, solely for the purpose of testing software applications that the Customer owns or has express authorization to test.
6.2 Prohibited Activities
The Customer and its Users agree not to:
- Use the Service in any way that violates any applicable law or regulation
- Use the Service to test applications, websites, or systems that the Customer does not own or does not have explicit written permission to test
- Use the Service to seek vulnerabilities in third-party systems for the purpose of unauthorized access, cyberattacks, or any malicious activity
- Transmit any material that is defamatory, offensive, or otherwise objectionable
- Attempt to gain unauthorized access to the Service, other Customers' accounts, or any computer systems or networks connected to the Service
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Use any automated system (including robots, spiders, or scrapers) to access the Service without express written permission
- Reverse engineer, decompile, or disassemble any aspect of the Service
- Attempt to circumvent any usage limits or restrictions placed on the Account
- Resell, redistribute, or sublicense access to the Service without express written permission
6.3 Consequences of Violation
Violation of the acceptable use provisions may result in immediate suspension or termination of the Account, as further described in Section 14. The Customer shall indemnify Cloud Automation Solutions EOOD against any damages, costs, or liabilities arising from the Customer's or its Users' violation of these provisions, including any third-party claims.
7. Rights and Obligations
7.1 Our Obligations
Cloud Automation Solutions EOOD undertakes to:
- Provide the Service in accordance with these Terms and the applicable Subscription
- Use commercially reasonable efforts to maintain the availability and security of the Service
- Provide reasonable technical support via support@bugzy.ai
- Notify the Customer of material changes to the Service or these Terms in accordance with Section 16
- Process the Customer's data in accordance with the Privacy Policy and DPA
7.2 Customer's Obligations
The Customer undertakes to:
- Use the Service in compliance with these Terms and all applicable laws
- Provide accurate and up-to-date Account information
- Pay all applicable fees in a timely manner in accordance with Section 8
- Ensure that all Users comply with these Terms
- Maintain the security and confidentiality of Account credentials
- Ensure that the Customer has all necessary rights and authorizations to grant access to its systems and data as required for the Service to function
- Review all AI-Generated Content before relying on it or using it in production
- Not upload or provide access to special category data (health, biometric, genetic, etc.) without prior explicit written authorization
8. Payment and Billing
8.1 Subscription Plans
The Service is offered through various Subscription plans with different features, usage limits, and pricing. The details of each plan, including applicable fees, are published on the Platform and may be updated from time to time.
8.2 Fees and Payment Methods
The Customer shall pay the fees associated with its selected Subscription. Payment must be made through the payment methods supported by the Platform (credit card, debit card, or other methods as may be offered). The Customer authorizes Cloud Automation Solutions EOOD to charge the Customer's selected payment method for all applicable fees. Subscription fees are billed in advance on a monthly or annual basis, as selected by the Customer.
8.3 Usage-Based Billing
Certain features of the Service may be billed based on usage (e.g., number of test runs, execution time). Usage charges are calculated monthly and billed in arrears. Cloud Automation Solutions EOOD will provide reasonable notice and transparency regarding usage-based charges.
8.4 VAT and Taxes
All fees are stated exclusive of applicable Value Added Tax (VAT), other taxes, duties, or similar governmental assessments. Cloud Automation Solutions EOOD will charge VAT according to Bulgarian and EU tax regulations. The Customer is responsible for paying all applicable taxes associated with its use of the Service.
8.5 Late Payment
If any payment is overdue, Cloud Automation Solutions EOOD reserves the right to:
- Charge default interest in accordance with applicable Bulgarian law
- Suspend the Customer's access to the Service after providing at least ten (10) days' written notice
- Terminate the Agreement if payment remains overdue for more than thirty (30) days
Suspension of the Service due to overdue payment does not release the Customer from its obligation to pay all outstanding fees.
8.6 Price Changes
Cloud Automation Solutions EOOD reserves the right to modify pricing. Price changes will take effect at the start of the next billing period and the Customer will be notified at least thirty (30) days in advance. If the Customer does not agree to the new pricing, the Customer may cancel its Subscription before the new pricing takes effect.
8.7 Subscription Cancellation
The Customer may cancel its Subscription at any time through the Account settings on the Platform. Upon cancellation:
- The Service will remain available until the end of the current paid billing period
- No refunds will be issued for any remaining portion of the billing period
- The Customer is responsible for exporting its data before the Account is deactivated
9. Intellectual Property Rights
9.1 Our Intellectual Property
The Service, the Platform, and all original content, features, functionality, software, algorithms, designs, and underlying technology are and remain the exclusive property of Cloud Automation Solutions EOOD and its licensors. The Service is protected by copyright, database rights, and other intellectual property laws of Bulgaria and the European Union.
The Customer shall not:
- Copy, reproduce, or distribute any part of the Service without written permission
- Modify, adapt, or create derivative works based on the Service
- Use the name, logos, or branding of Bugzy AI or Cloud Automation Solutions EOOD without prior written consent
- Attempt to decompile, reverse engineer, or extract source code from the Service
Any unauthorized use of the Service or its components may result in immediate suspension or termination of the Account, and Cloud Automation Solutions EOOD reserves the right to seek damages and equitable remedies, including injunctive relief.
9.2 Know-How Protection
Certain aspects of the Service, including proprietary methodologies, AI prompt engineering techniques, and testing algorithms, are protected as trade secrets and know-how. The Customer agrees not to disclose, reproduce, or exploit such proprietary information for any purpose other than its authorized use of the Service.
9.3 Your Content
The Customer retains all rights to Your Content. By submitting Your Content to the Service, the Customer grants Cloud Automation Solutions EOOD a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process Your Content solely for the purpose of providing the Service to the Customer.
Cloud Automation Solutions EOOD does not access, modify, or store Customer source code. The Service operates with read-only access to the Customer's documentation, issue trackers, and communication systems solely for the purpose of generating test plans and test cases. In the event this guarantee is breached, the Customer may terminate the Agreement immediately and Cloud Automation Solutions EOOD shall be liable for any direct damages resulting from such breach.
The Customer represents and warrants that:
- It owns or has the necessary rights to Your Content
- Your Content does not infringe any third-party intellectual property or other rights
- Your Content complies with all applicable laws
9.4 AI-Generated Content Ownership
AI-Generated Content produced by the Service for the Customer belongs to the Customer. Cloud Automation Solutions EOOD retains no ownership rights over AI-Generated Content specific to the Customer. However, Cloud Automation Solutions EOOD retains all rights to the underlying AI models, algorithms, and methodologies used to generate such content.
9.5 Feedback
Any Feedback provided by the Customer or its Users regarding the Service shall become the sole and exclusive property of Cloud Automation Solutions EOOD. The Customer:
- Grants Cloud Automation Solutions EOOD an irrevocable, perpetual, worldwide, royalty-free license to use, modify, and incorporate the Feedback in any manner
- Acknowledges that it will not be entitled to any compensation for Feedback
- Waives any intellectual property claims over the Feedback
- Acknowledges that all improvements, features, or innovations to the Service based on Feedback are the exclusive property of Cloud Automation Solutions EOOD
10. Content and Data
10.1 Content Processing
In connection with providing the Service, Cloud Automation Solutions EOOD may process the following types of content:
- Read-only access: Documentation, issue tracker data, communication system content (used to generate test plans; not permanently stored in raw form)
- Stored content: AI-Generated Content (test plans, test cases, bug reports), test execution results, screenshots, execution logs
- Account data: Customer and User identification and contact information
10.2 Data Retention
Content is retained for the periods specified in the Privacy Policy. Upon termination of the Agreement, the Customer has thirty (30) days to export its data. After this period, Cloud Automation Solutions EOOD will permanently delete the Customer's data in accordance with the DPA.
10.3 Liability for Content
Cloud Automation Solutions EOOD does not assume liability for loss of Your Content except where such loss is caused by Cloud Automation Solutions EOOD's negligence. The Customer is responsible for maintaining its own backups of Your Content.
11. Confidentiality
11.1 Obligations
Each party undertakes not to disclose the other party's Confidential Information to any third party without the prior written consent of the disclosing party. Each party shall use the other party's Confidential Information solely for the purpose of performing its obligations under these Terms.
11.2 Exceptions
The confidentiality obligations do not apply to information that:
- Is or becomes publicly available through no fault of the receiving party
- Was already known to the receiving party prior to disclosure
- Is independently developed by the receiving party without use of Confidential Information
- Is required to be disclosed by law, regulation, court order, or competent authority (provided the receiving party gives reasonable prior notice to the disclosing party where legally permitted)
11.3 Duration
The confidentiality obligations shall survive the termination of these Terms for a period of three (3) years, or indefinitely for trade secrets.
12. Third-Party Services and Integrations
The Service may integrate with Third-Party Services such as GitHub, Slack, Jira, and others. The Customer's use of these integrations is subject to the respective third party's terms of service and privacy policies.
Cloud Automation Solutions EOOD is not responsible for the availability, accuracy, or content of Third-Party Services. Any issues with Third-Party Services should be directed to the respective provider. Cloud Automation Solutions EOOD shall not be liable for any loss or damage resulting from the Customer's use of Third-Party Services.
13. Service Availability and Modifications
13.1 Availability
Cloud Automation Solutions EOOD will use commercially reasonable efforts to maintain the availability of the Service. However, the Service is provided without guarantees of uninterrupted, secure, or error-free operation. Cloud Automation Solutions EOOD may perform maintenance that temporarily affects access to the Service and will provide reasonable advance notice of planned maintenance where possible.
13.2 Modifications to Service
Cloud Automation Solutions EOOD reserves the right to modify, update, or discontinue features or functionality of the Service. Minor changes may be made without prior notification. Material changes that significantly affect the Customer's use of the Service will be notified at least thirty (30) days in advance. If the Customer does not accept a material change, the Customer may terminate the Agreement in accordance with Section 14.
13.3 Support
Cloud Automation Solutions EOOD provides technical support via support@bugzy.ai. Support is available during business hours (CET/CEST 09:00–18:00, Monday–Friday, excluding Bulgarian public holidays). Cloud Automation Solutions EOOD will use reasonable efforts to respond to support requests in a timely manner, but does not guarantee specific response times unless separately agreed.
14. Term and Termination
14.1 Term
These Terms enter into force upon the Customer's registration of an Account and remain in effect for the duration of the Customer's Subscription. Following the initial Subscription term, the Agreement will automatically renew for successive periods of equal duration unless either party provides written notice of non-renewal at least thirty (30) days before the end of the current term.
14.2 Termination by the Customer
The Customer may terminate its Account and cancel the Service at any time by:
- Using the Account deletion feature in the team settings on the Platform
- Contacting us at privacy@bugzy.ai
14.3 Suspension by Us
Cloud Automation Solutions EOOD may suspend the Customer's access to the Service with immediate effect if the Customer or any User:
- Breaches any material provision of these Terms, including the acceptable use provisions in Section 6
- Fails to pay any fees when due, after receiving notice in accordance with Section 8.5
- Uses the Service in a manner that causes or may cause damage to the Service or third parties
- Processes information in a way that infringes third-party rights or violates applicable law
Suspension is a separate measure from termination and does not in itself terminate the Agreement. The Customer may request reactivation by remedying the cause of suspension and contacting support@bugzy.ai.
14.4 Termination by Us
Cloud Automation Solutions EOOD may terminate the Agreement with immediate effect if:
- The Customer commits a material breach of these Terms that is not remedied within fifteen (15) days of written notice
- The Customer's Account has been suspended for more than thirty (30) consecutive days
- The Customer becomes insolvent, enters bankruptcy proceedings, or ceases operations
14.5 Effect of Termination
Upon termination:
- The Customer's right to use the Service will immediately cease
- Cloud Automation Solutions EOOD will retain the Customer's data for thirty (30) days to allow the Customer to export its data
- After the thirty (30) day period, all data will be permanently deleted except data that Cloud Automation Solutions EOOD is legally required to retain (e.g., financial records for tax purposes, retained for five (5) years under Bulgarian law)
- The Customer is not entitled to any refund of prepaid fees for the current billing period
- Provisions that by their nature should survive termination shall survive, including: Intellectual Property (Section 9), Confidentiality (Section 11), Limitation of Liability (Section 15), Indemnification (Section 17), and Governing Law (Section 19)
14.6 Data Recovery
Before termination takes effect, the Customer may export its data using the export features available in the Platform. If the Customer requires additional assistance with data export, it may request this by contacting support@bugzy.ai within the thirty (30) day retention period. Cloud Automation Solutions EOOD may charge a reasonable fee for extraordinary data recovery assistance.
15. Limitation of Liability
15.1 Exclusion of Indirect Damages
To the maximum extent permitted by Bulgarian law, neither party shall be liable to the other for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, arising from or related to the use of or inability to use the Service.
15.2 Liability Cap
Each party's total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the total amount of fees paid by the Customer to Cloud Automation Solutions EOOD in the twelve (12) months preceding the event giving rise to the liability.
15.3 Exceptions
The limitations in Sections 15.1 and 15.2 do not apply to:
- Liability arising from intent or gross negligence (per Bulgarian law, such liability cannot be contractually excluded)
- Liability under Section 9 (Intellectual Property Rights)
- Liability under Section 17 (Indemnification)
- Personal injury liability
- The Customer's obligation to pay fees owed under these Terms
15.4 Service Interruptions
Cloud Automation Solutions EOOD shall not be liable for damages resulting from service interruptions caused by scheduled maintenance (notified in advance), Third-Party Service outages, or force majeure events as described in Section 18. For unscheduled service interruptions caused by Cloud Automation Solutions EOOD's negligence, liability is subject to the cap in Section 15.2.
16. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. Cloud Automation Solutions EOOD does not warrant that:
- The Service will function without interruption or error
- Any errors or defects will be corrected within a specific timeframe
- The Service is free of viruses or other harmful components
- The results of using the Service will meet the Customer's specific requirements
- AI-Generated Content will be accurate, complete, or error-free
The Customer acknowledges that automated AI-powered testing is not a substitute for human review and that the Customer remains solely responsible for its software quality and testing processes.
17. Indemnification
17.1 Customer's Indemnification
The Customer agrees to defend, indemnify, and hold harmless Cloud Automation Solutions EOOD and its directors, employees, contractors, agents, and officers from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:
- The Customer's or its Users' use of the Service in violation of these Terms
- The Customer's violation of any applicable law or regulation
- The Customer's infringement of any third-party intellectual property, privacy, or other rights
- Any claim that Your Content caused damage to a third party
- The Customer's or its Users' testing of applications or systems without proper authorization
- The Customer's use of the Service for purposes outside the scope described in Section 4
17.2 Our Indemnification
Cloud Automation Solutions EOOD shall defend and indemnify the Customer against any third-party claims that the Customer's authorized use of the Service infringes a third party's intellectual property rights, provided that the Customer promptly notifies Cloud Automation Solutions EOOD in writing and grants sole control over the defense and settlement.
18. Force Majeure
Neither party shall be liable for any failure or delay in performance of its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond the party's reasonable control, including but not limited to: war or warlike situations, terrorism, sabotage, insurrection, natural disaster, epidemic, pandemic, fire, lightning, strike or other labor disputes, breakdown of data centers or relevant technical infrastructure, cybersecurity attacks, public authority orders, changes in legislation, discontinuation of energy supply, or faults or delays in services provided by third-party providers due to such circumstances.
If such circumstances persist for more than thirty (30) consecutive days, either party may terminate the Agreement by written notice without incurring liability for compensation. Upon such termination, Section 14.5 (Effect of Termination) shall apply.
19. Governing Law and Dispute Resolution
19.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Bulgaria, without regard to its conflict of law provisions.
19.2 Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall be resolved through:
- Informal Negotiation: The parties will first attempt to resolve any dispute informally by contacting support@bugzy.ai.
- Mediation: If informal negotiation fails within thirty (30) days, the parties agree to attempt mediation.
- Jurisdiction: If mediation is unsuccessful, disputes shall be resolved exclusively in the competent courts of Sofia, Bulgaria.
20. Changes to Terms
Cloud Automation Solutions EOOD reserves the right to modify these Terms. Minor changes (not of material significance to Customers in general) may be made without prior notification. Material changes will be notified to the Customer via email or through the Platform at least thirty (30) days before they take effect.
If the Customer does not accept a material change, the Customer may terminate the Agreement by written notice no less than seven (7) days before the change takes effect. In such case, Cloud Automation Solutions EOOD will refund any prepaid fees covering the remainder of the term following termination.
21. Data Processing and Privacy
The Customer's use of the Service is governed by our Privacy Policy, which explains how we collect, use, and protect personal data, and our Data Processing Agreement, which constitutes an appendix to these Terms.
21.1 Data Protection
Cloud Automation Solutions EOOD processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and the Bulgarian Personal Data Protection Act (PDPA).
21.2 Data Roles
For Account data and usage data, Cloud Automation Solutions EOOD acts as the data controller. For data from the Customer's systems (documentation, issue trackers, communication systems), Cloud Automation Solutions EOOD acts as a data processor and the Customer remains the data controller.
21.3 DPA Acceptance
By accepting these Terms, the Customer also accepts the Data Processing Agreement, which governs the processing of personal data by Cloud Automation Solutions EOOD on behalf of the Customer.
21.4 Customer Responsibilities
The Customer is responsible for:
- Ensuring it has the necessary rights and consents to grant access to its systems and data
- Complying with GDPR and other applicable data protection laws
- Not uploading or providing access to special category data (health, biometric, genetic data, etc.) without prior explicit written authorization
- Informing its users that a third-party AI testing service processes data from the Customer's systems
22. Severability
If any provision of these Terms is held to be unenforceable or invalid by a competent court, the remaining provisions shall continue in full force and effect. The parties shall negotiate in good faith to replace the invalid provision with a valid one that most closely reflects the original intent.
23. Assignment
The Customer may not assign, transfer, or sublicense these Terms or any rights or obligations hereunder without the prior written consent of Cloud Automation Solutions EOOD. Cloud Automation Solutions EOOD may assign these Terms to a group company, or in connection with a merger, acquisition, or sale of substantially all of its assets, without the Customer's prior consent.
24. Waiver
No failure or delay by Cloud Automation Solutions EOOD in exercising any right or provision under these Terms shall constitute a waiver of such right or provision.
25. Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, and DPA, constitute the entire agreement between the Customer and Cloud Automation Solutions EOOD regarding the use of the Service and supersede all prior and contemporaneous agreements.
